Will: A legal document in which a person, the testator, makes sure that his/her property is distributed in accordance with their wishes after death.
Estate: The sum total of all property owned by a person at a particular time.
Top 3 reasons you should have a will:
1. You decide HOW your estate will be distributed and by WHO 2. It can save you time, costs and alleviate possible disputes 3. You can plan for your family’s future
Drafting a will is an intricate process and the Wills Act provides requirements for a valid will. The requirements are as follows:
1. The testator must be 16 years or older 2. The will must be in writing 3. The testator must sign at the end of the will. If the will is more than one page, the testator must also sign every other page 4. The testator must sign the will in the presence of 2 competent witnesses (both signing at the same time) 5. A beneficiary or executor should not sign as a witness to the will
It is therefore imperative that you have a professional draft your will. CNG Attorneys participates in the National Wills Week annually that provides a service of drafting your will for free during that week.
